Terms of purchase

Contractual information applicable to online purchases of Martín de Prado products delivered in mainland Spain.

Version 1.2 · Updated on 5 October 2026

1. Seller identity and contact details

The Martín de Prado online shop is operated by PRISMA, INICIATIVAS GOURMETS EXTREMEÑAS, S.L., whose details are:

  • Tax identification number (NIF): B06472062.
  • Registered office: Polígono Industrial Arroyo Caballo, calle 1, 93-95, 10200 Trujillo (Cáceres), Spain.

  • Customer service email: info@martindeprado.es.
  • General customer service telephone: +34 680 422 774.
  • Telephone recommended for returns: +34 680 422 790.

The company is referred to below as “Martín de Prado”. Customers may use the contact details above for enquiries about a product, order, delivery, return or complaint.

2. Purpose, scope and acceptance

These terms govern purchases of products offered in the Martín de Prado online shop. Before completing an order, customers may consult, save and reproduce these terms and must expressly accept them by ticking an unticked checkbox.

By clicking the “Order with obligation to pay” button, the customer declares that the information supplied is correct, that they know the total price and that they accept the version of the terms displayed during checkout. Acceptance will be stored with the order, together with its date and version.

The shop is intended for adults with the legal capacity to enter into contracts. Purchases may be made as a guest or through an account; registration is not compulsory.

3. Product information

Before purchase, each product page will show the product's essential characteristics, format, net quantity, price, availability and the mandatory food information that applies. The date of minimum durability or best-before date and all other required particulars will appear on the product delivered.

Images are intended to represent the products faithfully, although minor differences in colour or presentation may arise from the screen, packaging or design updates. Such differences will not reduce the contracted characteristics, quantity or quality.

Customers must follow the storage instructions shown on the product page or label. Oil must be kept under the recommended conditions and protected from heat sources and direct light.

4. Availability

Products are shown as available or unavailable, without displaying specific stock quantities. An unavailable product cannot be added to the basket or paid for.

Before payment starts, Martín de Prado will recheck on the server the availability, configuration and price of every item. If a product saved in the basket becomes unavailable, checkout will be blocked until that item is removed or the basket is changed.

If, exceptionally, a product becomes unavailable after payment, Martín de Prado will notify the customer without delay and refund in full the amount charged for that product or, if the whole order is affected, for the entire order. No substitution will be made without the customer's express consent.

5. Prices, taxes and charges

All amounts are stated in euros and include the applicable VAT. Before the order is confirmed, the product subtotal, delivery charges, any valid applicable discounts and the total including taxes will be displayed separately.

Delivery costs 12 EUR. It is free when the product subtotal, after applicable discounts and before delivery is added, is 180 EUR or more.

If an obvious pricing error is identified before dispatch, Martín de Prado will inform the customer. The customer may confirm the purchase at the correct price or cancel it for a full refund. Martín de Prado will not unilaterally alter the price of an order that has already been confirmed.

6. Purchase process and formation of the contract

The customer will select the products, review the basket, provide the required information, check the final summary and accept these terms before paying.

Technical receipt of a payment request does not by itself constitute acceptance of the order. The contract is concluded when payment has been authorised and Martín de Prado sends the order confirmation to the email address provided. That confirmation will include, or allow the customer to retain, the purchase summary and the accepted terms.

If the customer does not receive confirmation within a reasonable period, they should check their spam folder and contact Martín de Prado before attempting payment again.

The contract will be stored electronically. Registered customers may view their orders through their account; guests will receive a secure link to access their order, in addition to the email confirmation. Before paying, information and products may be corrected by returning to previous checkout steps. The contract will be concluded in the selected language from those available in the shop.

7. Payment

Payment will be processed securely through Stripe using the methods displayed at checkout. Martín de Prado does not store complete card details. The card issuer or Stripe may decline the transaction in accordance with their authentication and fraud controls.

No surcharge will be applied for using an ordinary payment method offered by the shop. If payment fails or remains incomplete, the order will not be deemed confirmed. Any temporary hold on funds resulting from a failed attempt will be released by the payment provider or card issuer in accordance with their time limits.

8. Receipt and invoice

Martín de Prado will provide, free of charge, a receipt recording the essential terms of the transaction. The customer is entitled to receive a paper invoice at no cost.

Billing information must be supplied correctly during checkout or requested through customer service. The issue and, where appropriate, correction of the invoice will comply with applicable tax law.

Checkout requires the invoice recipient's DNI/NIF/NIE number; the online purchase cannot be completed without a valid identifier. When delivery and billing details are the same, the main form is used. If you provide different billing details, the identifier is required in that second form and no additional identifier is collected for delivery. Details of both addresses are stored separately. The company field is optional. You must check that the invoice recipient's name or company name, identifier and address are correct; any clarification or correction will be handled through the customer service channels provided.

9. Delivery destinations

The online purchase process and delivery price described above are available only for delivery to residential addresses in mainland Spain. Online delivery is not available to post office boxes, collection points, the Balearic Islands, Canary Islands, Ceuta, Melilla or foreign countries.

Anyone requiring delivery to one of those destinations must contact Martín de Prado beforehand by email or telephone. That enquiry does not constitute an order, and any exceptional sale or transport arrangement will require a separate offer and acceptance.

10. Preparation, carriage and delivery time

Orders are delivered by TIPSA to the address entered during checkout. The estimated delivery time is 48 to 72 working hours from order confirmation, unless a different period is stated on the product page or at checkout before payment. Saturdays, Sundays and public holidays at the place of origin or destination are not working days.

This period is an estimate, not a guaranteed date or an essential term of the contract unless Martín de Prado expressly accepts it in writing. It may be affected by peaks in demand, logistical incidents, weather conditions, traffic restrictions, strikes or other reasonably unavoidable circumstances. A delay beyond the estimate does not in itself give rise to automatic compensation. Martín de Prado will report material delays and preserve the customer's mandatory rights, including the right to require delivery within an additional reasonable period or terminate the contract where legally applicable. Unless otherwise agreed, delivery will take place within the statutory maximum period.

The risk of loss or damage remains with Martín de Prado until the customer, or a third party designated by the customer other than the carrier, physically receives the order.

Martín de Prado holds an ordinary TIPSA customer account, with no notified special terms altering the general carriage regime. As carrier, TIPSA is liable to Martín de Prado, to the extent applicable, for loss, damage or delay from receipt of the goods until delivery, subject to the exemptions and limits provided by applicable law and the terms of the contracted service. Martín de Prado's assistance to the customer does not mean that Martín de Prado assumes the cause of a logistical incident as its own, nor does it prevent a subsequent claim against TIPSA.

Under TIPSA's public procedure, if goods are lost or arrive damaged, the recipient must notify the sender. Martín de Prado will therefore centralise assistance to the purchaser and, where appropriate, submit the claim to TIPSA or its branch. The customer must cooperate by providing the information and evidence reasonably required.

11. Address, receipt and failed deliveries

The customer must provide a complete and correct address and a working contact telephone number, respond to reasonable communications from the carrier and ensure that somebody can receive the order. A correction may be requested before dispatch; if the order is already being prepared or transported, Martín de Prado cannot guarantee that the change can be made and may charge the actual additional cost after notifying it in advance.

If the order is returned to Martín de Prado because the address is incorrect or incomplete, or because of a failure to receive it attributable to the customer, the customer may choose between:

  • A new delivery, after paying the actual additional costs notified.
  • Cancellation, with the product price refunded once the products have been received and checked, deducting only the direct transport costs actually incurred where permitted by law.

Those costs will not be charged where the failed delivery is attributable to Martín de Prado or the carrier.

Unjustified refusal of the parcel or failure to collect it does not in itself constitute valid notice of withdrawal. If it causes the order to be returned, the rules above will apply and, where the customer subsequently gives notice of withdrawal within the relevant period, the rules governing an ordinary return will also apply.

12. Cancellation before dispatch

The customer may request cancellation, quoting the order number, by emailing info@martindeprado.es or, preferably for returns, by calling +34 680 422 790.

Martín de Prado will try to fulfil the request if the order has not yet been handed to TIPSA. Cancellation is accepted only when confirmed by the company. If the order has already been dispatched, stopping it cannot be guaranteed and the request will be handled under the right of withdrawal after receipt; the customer will bear the direct cost of the ordinary return where applicable.

Martín de Prado may cancel an order because of subsequent unavailability, inability to validate payment, reasonable suspicion of fraud or impossibility of delivery within the admitted area. It will inform the customer and refund any amount charged without undue delay; cancellation will not restrict any statutory rights the customer may have.

13. Right of withdrawal

Where legally applicable, the customer has 14 calendar days to withdraw from the purchase without giving any reason. The period begins on the day when the customer, or a third party authorised by the customer, physically receives the order; if goods from the same order are delivered separately, it begins when the last item is received.

To request a return, the customer must contact Martín de Prado before the applicable time limit expires by using:

  • The email address info@martindeprado.es, stating the customer's details and order number.
  • The telephone number +34 680 422 790, providing the same information.

Where the request consists of exercising the right of withdrawal, the customer must communicate the decision to withdraw from the purchase unequivocally. The customer may also use the model form included at the end of these terms, although its use is not compulsory. Martín de Prado will confirm receipt of the request and provide the instructions required for the return.

After giving notice of withdrawal, the customer must send or deliver the products within the following 14 calendar days to:

PRISMA, INICIATIVAS GOURMETS EXTREMEÑAS, S.L. — Polígono Industrial Arroyo Caballo, calle 1, 93-95, 10200 Trujillo (Cáceres), Spain.

The customer will bear the full direct cost of the ordinary return. The customer may use a tracked carrier or ask Martín de Prado to arrange collection; in the latter case, the exact cost will be notified and must be accepted in advance. Cash-on-delivery or carriage-forward returns will not be accepted.

Products must be returned complete, with their accessories and properly protected, using the original packaging and protection equivalent to that used for delivery whenever reasonably possible. Until receipt, the customer is responsible for damage caused by improper handling or return packaging. Use of a tracked service and retention of proof of dispatch are recommended. The customer is liable for any reduction in value caused by handling other than that necessary to establish the nature and characteristics of the product.

14. Exceptions to the right of withdrawal

The right of withdrawal does not apply in the circumstances provided by law. All products sold are properly sealed and have tamper-evident closures. In particular, withdrawal will not be accepted for bottles, tins or other food products whose security seal, tamper-evident closure or primary packaging has been opened or altered after delivery where, for health protection or hygiene reasons, the product is no longer suitable for return. This exception must be stated on the product page and before payment, and will apply only to products delivered with the seal intact.

Opening the outer shipping box does not in itself remove the right if every food container and seal remains intact. A taste preference or change of mind after opening the container is not a defect or lack of conformity.

The above does not affect the customer's rights if the product is incorrect, damaged or not in conformity with the contract.

15. Refund following withdrawal

Martín de Prado will refund all payments required by law, including the cost of ordinary delivery where the entire order is withdrawn, within 14 calendar days from the date on which notice of withdrawal is received.

If the customer selected a delivery method more expensive than the ordinary method offered, the supplement will not be refunded. For partial withdrawal, the price of the items and any delivery charges required by law will be refunded.

Martín de Prado may withhold the refund until it receives the products or the customer supplies sufficient evidence of their return, whichever occurs first. The refund will be made using the same payment method used for the purchase, unless a different method that causes no cost to the customer is expressly agreed.

16. Damaged, incorrect, incomplete or non-conforming product

If an order arrives damaged, contains a different product, is incomplete or lacks conformity, the customer must contact Martín de Prado, quote the order number and describe the incident. To preserve evidence and allow a claim against the insurer or carrier, customers are advised to do so within the first 48 hours, retain the product and all packaging, and attach photographs of the exterior, internal protection, transport label and contents.

Where damage, moisture, leakage, breakage or missing packages are visible on delivery, the customer should try to record a detailed reservation on the carrier's delivery document before signing it. Failure to notify within 48 hours or make a reservation does not automatically extinguish the customer's statutory rights, but may make it harder to prove that the damage existed on delivery; Martín de Prado may request additional reasonable evidence.

Martín de Prado may request information, photographs or return of the product to verify the incident. Once verified, it will offer the appropriate and proportionate statutory remedy—normally replacement where available and, where applicable, a price reduction or refund. The remedy will be free to the customer where the cause is attributable to Martín de Prado or TIPSA. The company may recover the relevant sums and losses from the carrier without requiring the customer to make that claim directly, although the customer must reasonably cooperate in documenting it.

Products are covered by the statutory conformity guarantee for the periods laid down by law. For new goods, the general period is three years from delivery. Assessment will take into account the food nature of the product, its best-before date, storage conditions and use. The guarantee does not cover deterioration due to storage contrary to the label, impacts after delivery or normal consumption, but no clause restricts the customer's statutory rights.

17. Allocation of responsibility

Without prejudice to consumers' mandatory rights, Martín de Prado is not liable for incidents, costs or damage caused by:

  • Incorrect, incomplete or outdated information supplied by the customer.
  • Absence, unjustified refusal, failure to collect, or instructions from the recipient.
  • Delivery changes requested after the order has been dispatched.
  • Handling, impacts, opening, contamination or loss occurring after delivery.
  • Storage or use contrary to the label or product instructions.
  • Fraudulent or abusive conduct.
  • Unavoidable extraordinary events whose consequences could not have been prevented by exercising reasonable care.

TIPSA is liable to Martín de Prado for loss, damage and delay attributable to it during carriage in accordance with applicable law and the general terms of the contracted service. The customer is responsible for causes attributable to the customer, and Martín de Prado for preparation, packaging or management errors attributable to it. Where several causes coincide, responsibility will be determined according to each party's contribution.

These rules do not remove the customer's right to address Martín de Prado as seller and do not exclude any obligation that consumer law treats as mandatory.

18. Customer service and complaints

Enquiries and complaints may be sent to info@martindeprado.es, the general telephone number +34 680 422 774, the telephone number recommended for returns +34 680 422 790, or by post to the registered address stated in these terms. Martín de Prado will provide a record of the complaint on a durable medium and respond as soon as possible and, in all cases, within a maximum of 15 days after it is submitted.

Martín de Prado has official complaint forms available to consumers. Their use is compatible with submitting a complaint by email, post or any other means permitted by law.

The company is not a member of Spain's Consumer Arbitration System. If the response is unsatisfactory, the consumer may contact the public consumer services or another competent alternative dispute resolution body where applicable. Non-membership does not restrict access to public bodies, available mediation, or the competent courts. The former European online dispute resolution platform is not linked because it ceased operating and its regulation was repealed in 2025.

19. Personal data

Order data will be processed to manage the purchase, payment, delivery, after-sales service and legal obligations. Full information on controllers, legal bases, recipients, retention and rights will be available in the Privacy Policy linked from checkout and the footer.

Acceptance of these terms does not constitute consent to receive marketing communications.

20. Governing law and jurisdiction

These terms are governed by applicable Spanish and European law. Every clause will be interpreted consistently with the mandatory rights of consumers and users.

If an amicable solution cannot be reached, the parties may apply to the courts having jurisdiction under the law. Where the customer acts as a consumer, the customer is not deprived of the courts of their place of residence or of any mandatory protection to which they are entitled.

21. Severability, versions and amendments

Invalidity of one clause will not affect the remaining terms. Martín de Prado may update these terms for future purchases, but no amendment will apply retroactively to contracts already concluded. The version and date accepted will be associated with the order.
